I. Acceptance of Terms
Shadow Poetry provides its service to you as website, learning/sharing tool,
contest host, magazine publisher, and independent chapbook publisher subject to the following Terms of
Service (TOS), which may be updated by us from time to time without notice to you.
II. Description of Service
Shadow Poetry Services currently provide users with: access to interactive mailing lists (intended for educational
purposes and/or personal enjoyment), as an educational tool (for beginning as well as advanced poets),
interactive activities, resource outlet for outside reading
material, membership to the Shadow Poetry's message board, contest host for six contests with entry fees and
three that are free, a member section for display of personal poetry with a yearly fee, selective publishing
opportunities in the SP Quill Quarterly Magazine and/or White Lotus Biannual Magazine as well as a magazine subscription service, chapbook
publisher to publish personal poetry manuscripts for a fee, and
an online bookstore featuring books, chapbooks, magazine issues, journals, supplies, gift certificates, and more!
III. Your Membership Obligations
In order for you to use Shadow Poetry Services, you are under the obligation to
abide by the following: a) Provide accurate registration/submission information
b) Promptly updated registration/submission information (i.e. age, email address, etc.)
c) Comments or criticism must be kept positive in nature d) Maintain a high level of
maturity e) Refrain from any ethnical or racial stereotyping f) Pay yearly membership fee
to continue service (Shadow Poetry's Community of Poets section only).
IV. Message Board & Member Poetry, Password and Security
You will receive a password and account upon completing the Message Board registration
process and/or become a member of Shadow Poetry's Community of Poets. You are responsible
for maintaining the confidentiality of the password and
account, and are fully responsible for all activities that occur under your password
or account. You agree to notify Shadow Poetry of any unauthorized use of your password
or account. Shadow Poetry cannot and will not be liable for any losses or damages
resulting from your failure to comply with this section.
V. Member Conduct
You understand that all information, photographs, graphics, data, text, posts,
messages or other content whether publicly posted and/or privately transmitted,
are the sole responsibility of the person from which such content was placed.
This means that you are entirely responsible for all content that you post, email,
upload, transmit or otherwise make available through Shadow Poetry Services. You
understand that by using Shadow Poetry Services, you will be exposed to content that
one may find offensive, indecent or objectionable. Under no circumstances will Shadow
Poetry be held liable in any way for any content, whether emailed, posted, transmitted
or otherwise made available through Shadow Poetry Services.
You agree to not use the Service to:
a) Post, upload, email, transmit or otherwise make available any content that is
vulgar, obscene, harmful, threatening, abusive, harassing, defamatory, unlawful,
invasive of another's privacy, hateful, racist, or ethnically objectionable. b)
Impersonate any persons or entities, such as other members, Shadow Poetry staff, or
forum moderators. c) Upload, email, post, transmit or otherwise make available any
content that you do not own the rights to do. d) Email, upload, post, transmit or make
available any content that infringes the patents, trademarks, or copyrights of such
material. e) Upload, post, email, transmit or make available any unsolicited or
unauthorized advertising such as promotional materials, junk mail, or spam. f) Transmit,
email, or make available any material that contains software viruses, computer code, files,
or programs designed to interrupt, destroy, or limit the functionality of any software
and/or hardware. g) Interfere with or disrupt the services Shadow Poetry provides. h)
Slander or harass other members of Shadow Poetry privately or publicly.
You agree that Shadow Poetry may:
a) Terminate your membership should you violate any TOS written or unwritten without
prior notification. b) Deny any submissions, posts, email, files, or uploads, that
violate the TOS without warning or reply. c) Deny publication in the Shadow Poetry
collective works should you fail to meet required deadlines or qualifications. d)
Deny any award applications should said application fail to meet proper requirements.
e) Revoke any given award should you fail to meet proper restrictions, or violate
any code of ethics in connection to said award.
Depending on the severity of violation of the Shadow Poetry TOS, you will first be warned,
and your accounts and/or dealings with SP will be suspended. The second violation will result in termination
of all accounts and/or services you may use with Shadow Poetry.
